ToS
The use of services from ITNetConsult Inc [hereafter referred to as “GameServer24”] constitutes agreement to these terms. By accepting these Terms of Service (TOS) you also accept our Privacy Policy. You confirm that you are at least 13 years old and that you have the right, authority and capacity to enter into any agreement with GameServer24.
Account Setup / Registration
It is your responsibility to ensure that your provided email address is valid and up to date at all times. If there is ever an abuse issue or we need to contact you, your provided email address will be used for this purpose. Failure to do so constitutes a breach of the TOS, which may result in immediate termination of your account on our Service.
You are responsible to keep your password safe and not disclosure it to any third parties. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Changes
GameServer24 has the sole right to at any time amend or supplement these Terms. Any such made changes to these Terms of Service will be immediately effective after being posted at the same location as these Terms of Services.
Responsibility
The use of the service and the information provided through it is the responsibility of the customer. All services provided by GameServer24 may only be used for lawful activities and we comply with the local laws of the countries we do business with.
Disclaimer and limitation of liability
GameServer24 shall not be liable to the customer for harm caused by or related to the customer’s services or inability to utilize the services unless caused by gross negligence or wilful misconduct.
GameServer24 shall not be liable to the customer for lost profits, indirect, special, or incidental consequential or punitive damages. Notwithstanding anything else in this Agreement, the maximum aggregate liability of GameServer24 and any of its employees, agents, or affiliates, under any theory of law, shall not exceed the amount paid by the Customer for hosting services for the three months prior to the occurrence of the event(s) giving rise to the claim.
GameServer24 does not guarantee the quality, suitability, safety or ability of any third-party service providers, such as the service providers for whom GameServer24 is reselling services and cannot be made responsible for any actions or services performed, or products delivered, by such third-party service providers. You therefore waive and release GameServer24 from all liability, claims or damages arising from, or that are in any way related to any third-party service providers. GameServer24 will not be a party to disputes or negotiations between you and such third-party service providers.
Indemnity
You shall indemnify and hold GameServer24 and its officers, directors, employees, agents etc. harmless from any claims, demands, losses, liabilities, and expenses arising out of or in connection with your use of the Services and the domain name, your breach of these Terms of Service, or your violation of the rights of any third party.
Payment Information
We accept cryptocurrencies like Bitcoin, Lightning and Monero directly with our self-hosted BTCPayServer and other cryptos via TrocadorApp. For fiat payment methods we accept PayPal and bank transfers. All services are prepaid. We will send you an invoice for your service renewal 10 days before its renewal date. Any hosting account more than 5 days overdue will be suspended. Any account with an overdue more than 15 days will simply be terminated. All data will be removed. GameServer24 will not activate new orders or activate new packages for customers who have an outstanding balance with GameServer24. For a new order to be setup or a new package to be activated, you must have a balance of 0.00 EUR, unless otherwise stated by GameServer24 in writing.
Refunds
All sales are final, and no refund will be issued.
Bandwidth Usage
The Customer are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package. Should the account of the Customer pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.
Price Change
We reserve the right to change prices listed on gameserver24.io, and the right to increase the number of resources given to plans at any time.
The Customer is ultimately responsible for the backup of their information.
GameServer24 is not responsible for any kind of data loss.
If the customer has lost their account login and could not be verified to regain access to their account, the account will be closed for security reasons.
Country restrictions
Citizens and companies incorporated within Seychelles are prohibited from using GameServer24.
Service Provisioning
Dedicated servers are configured to be setup automatically after a successful payment.
Placed but unpaid orders for more than 24 hours may be deleted from our system.
Support
All services of GameServer24 are unmanaged unless otherwise specified on the product information. Support tickets are usually answered within 24 hours. Sales related tickets have a lower priority and therefore the answer can take longer. We always prioritize existing customers’ and services’ tickets for incoming tickets.
